The Gauhati High Court on February 12 in a order said that the court feels Jaydeb, who was declared a foreigner on August 8, 2018 after he was suspected to be a foreigner in 2016 and a reference case was sent to the Foreigners’ Tribunal –III, at Karimganj, should be given a final opportunity to prove his citizenship claims since he was declared a foreigner by an ex-parte judgement and he had never appeared for trial.
The high court has asked the Foreigners’ Tribunal for arranging a fresh hearing of Jaydeb.
After coming out of the detention centre, Jaydeb claimed that in the writ petition filed in the High Court, he mentioned that no notice was served to him and also said that he had voted in the 2019 Lok Sabha elections as well.

“I am a poor man and used to work in a canteen. I had voted in the 2019 Lok Sabha election. However, I was clueless and was looking for ways to save my 17-year-old son suffering from cancer. I could not save him because of monetary issues.
“I was picked up by the police and without any opportunity to put forth my point, I was sent to the detention camp,” Ghosh said alongside his brother Dipak Ghosh and Kamal Chakraborty, social activist and member of a local NGO.
Kamal Chakraborty claimed that like four others of his family who have been declared Indian citizens earlier, Ghosh has all the valid documents to prove his claims of being a citizen of the country in his case bearing number WP (C) 4215/2019 at the High Court.
