Advocate Durga Prasad Jaiswal has been appointed as a special public prosecutor in the trial of physician Deben Dutta lynching case.

Jaiswal has been appointed as per the order of the governor in exercise of powers conferred by section 24 (8) of the Criminal Procedure Code.

The trial in the case began on Wednesday in the court of Jorhat district and sessions judge.

Dutta, a senior medical officer of Teok tea estate in Upper Assam’s Jorhat district, was lynched by a mob on August 31 at the hospital of the tea estate.

“Today is the first day of the trial which begins in the court sessions judge, Jorhat. After framing the charge against the accused they were sent back to judicial custody,” said Jaiswal.

He said the accused persons have been charged under sections 302, 341, 342, 427, 506, 186, 143, 144, 147 and 148 of Indian Penal Code.

The next date of the trial has been fixed on November 4.

The special investigation team had filed the charge sheet against 32 accused on September 23.

Jaiswal is also looking after the trial of Jhankar Saikia which is underway in the court of sessions judge, Diphu in Karbi Anglong district.

Jhankar, a BA first year student of Diphu College, was beaten to death at Diphu town by a group of auto-rickshaw drivers on June 25 in 2013 following a clash broken out over auto-rickshaw fare.
