The Mangaldai Bar Association has once again moved the Gauhati High Court for resumption of the physical functioning of the subordinate courts of Assam’s Darrang district considering the pitiable economic condition of the several hundreds of lawyers.

In a memorandum addressed to the Chief Justice of the Gauhati High Court recently, the Mangaldai Bar Association president Madhab Ch Rajbongshi and secretary Hemanta Kr Sarma have highlighted the bad economic condition of lawyers due to lack of physical functioning of the courts since March 2020.

The Mangaldai Bar Association had also approached the high court in November last year for resumption of lower courts in the state.

The memorandum also stated that the legal fraternity is being deprived of the opportunity of participating in trial matters under the present virtual court system, which is being followed as per notifications issued by the high court on account of the ongoing Covid-19 pandemic.

“Lawyers merely cannot survive on urgent matters like bail, zimma or temporary injunctions. It is impossible to survive without actual work and professional fee,” said Madhab Ch Rajbongshi.

“We appealed to the Chief Justice to allow physical court from the current month by maintaining full Covid protocols.  Vaccinated lawyers should be allowed to enter the court rooms and conduct cases as provisions for protected plastic barriers to curb spread of Covid-19 are already in practice there,” he said.

Moreover due to the long disruption of the normal functioning of the court, the justice delivery mechanism is on the verge of breakdown.
