“Government has directed to show-cause under Sub-Section 2 of Section 125 of Assam Panchayat Act, 1994 as to why the Barpeta Zilla Parishad should not be dissolved for its abuse/misuse of power and persistent default in performing its duties as allotted,” a Panchayat and Rural Development statement said.

As per provisions in the Section 105, Sub Section 6 (a) and (b) of Assam Panchayat Act, 1994 a Zilla Parishad should share the revenue with its Anchalik Panchayats and Gaon Panchayats. But Barpeta Zilla Parishad in its previous and present tenure has not shared the revenue as per provision of the Act, it said.

Section 125 of the said Act provides that in case of abuse of power and/or persistent default in performance of duties, the Zilla Parishad could be dissolved by the Government.

The failure of the Barpeta Zilla Parishad to share revenue with Anchalik Panchayats and Gaon Panchayats as per provision of the Act continuously proves the misuse of powers of Zilla Parishad and persistent failure in performance of its duties as allotted.

Hence taking step to dissolve it the Government has issued show cause notice to Barpeta Zilla Parishad.
