Rules under Citizenship (Amendment) Act, 2019 under preparation: Centre

The rules for implementation of the Citizenship (Amendment) Act, 2019 [CAA] are under preparation, Union minister of state for home Nityanand Rai told the Lok Sabha on Tuesday.

In the written reply to a question by Assam’s Congress MP Abdul Khaleque, MoS for home Rai said the CAA, 2019 was notified on December 12, 2019 and it has come into force from January 10, 2020.

“The Citizenship (Amendment) Act, 2019 [CAA] has been notified on December 12, 2019 and has come into force w.e.f. January 10, 2020. The rules under the Citizenship (Amendment) Act, 2019 (CAA) are under preparation.”

“The Committees on Subordinate Legislation, Lok Sabha and Rajya Sabha have granted extension of time up to April 9, 2021 and July 9, 2021 respectively to frame these rules under the Citizenship (Amendment) Act, 2019 (CAA),” Rai said.

Khaleque sought the details regarding various communications and instructions sent by the Registrar General of Citizen Registration of India, office of the Registrar General and Census Commissioner to the state coordinator of the National Register of Citizens (NRC), Assam during 2019 and 2020.

Minister Rai in his reply said: “Several communications and instructions have been sent to the state coordinator of National Register of Citizens (NRC), Assam for complying the orders of Hon’ble Supreme Court with regard to disposal of claims and objections, publication of lists of inclusions and exclusions in NRC, etc.”

He also said letters were issued for completing pending works as per the approved Standard Operating Procedures (SOPs) and complying with the directions issued by the Supreme Court within the deadlines fixed.

“The Supreme Court has directed the state coordinator to enact an appropriate security regime on lines similar to the security regime provided for Aaadhaar data and only thereafter the list of inclusions and exclusions shall be made available to the state government, central government and Registrar General India,” Rai told the Lok Sabha.

The Citizenship (Amendment) Act, 2019 facilitates granting of Indian citizenship to the non-Muslim minority people including Hindu, Sikh, Jain, Buddhist, Parsi and Christian, who were persecuted from Pakistan, Bangladesh and Afghanistan.

Under the Act, these non-Muslim communities, who had come to India till December 31, 2014 due to religious persecution in the three countries will be given Indian citizenship.

The Act was passed by Parliament in December 2019 and it triggering massive protests in different parts of the country and protests still continue in Assam and some other parts.

The President gave his assent to the legislation on December 12, 2019.
