Rupjyoti Kurmi had won the Assembly elections held in Assam earlier this year from Mariani seat on a Congress ticket.
Later, after Congress failed to win the Assembly elections, Kurmi quit the party and joined the BJP. He had resigned as an MLA after quitting Congress, necessitating by-polls.
Mariani, along with Tamulpur, Gossaigaon, Bhabanipur and Thowra constituencies, will go to polls on October 30. Votes will be counted on November 2.
