Bhargav Bhusan Bhuyan, a resident of Teok in Jorhat district today filed a  complaint before the National Human Rights Commission (NHRC) against Golaghat  Deputy Superintendent of Police, Partha  Protim Saikia for allegedly killing Gyanendra Rajkhowa, a mentally disturbed ex-BSF jawan on the day of the first phase Panchayat election in Assam on December 5.

In his complaint Bhuyan alleged that on Wednesday when the Panchayat poll was going on, the deceased reportedly displayed a machete to threaten local villagers near a polling station under Khumtai Assembly Constituency in Golaghat district.  However, he was overpowered by unarmed people present at the spot and the deceased returned home. Thereafter a police team led by DSP Saikia reached the house of the deceased and seeing the police the decease again flashed the machete. At this the police team fired at the deceased from point blank range above his waistline resulting in his death.

“There are a lot of non lethal options available for the police team to overpower the deceased but instead police fired at him without warning. People like Saikia are not fit to be in the police department.” Bhuyan said

“I urge the NHRC to intervene in the matter and instruct the state government to take necessary action against the DSP Saikia”  Bhuyan added.

A case under section 302 of IPC has already been registered against Saikia but till date no action has been initiated against him.
