One Samu Tapna of Udalguri in Assam has been sentenced to five years’ rigorous imprisonment (RI) for “cheating and raping” his 19-year-old girlfriend.
A Times of India report stated that the Additional Session Judges’ Court in Udalguri, upholding the judgement of a lower court, also slapped a fine of Rs 5,000 on Samu failing which he will have to undergo simple imprisonment for one month one-year RI.
The report further stated that in January 2017, the rape survivor had filed a police complaint after accused Samu confessed to his crime before a village court in Paneri area of Udalguri district. The victim had approached the police after Samu refused to marry her though she was “pregnant with his child” by then.
“The victim girl alleged that on Christmas in 2015, the accused called her to his house and had physical relationship with her by promising to marry her. She did not inform the matter to her family members as the accused threatened not to divulge the same. But, when she became pregnant, she informed the matter to her mother. Then, a village meeting was held in which the accused admitted to his crime. But, the accused did not marry her and fled after which she filed the case,” a source stated.
The court, in its order, observed, “In the present case, the accused had physical relationship with the victim by giving false assurance that he would marry her. It is evident that he never intended to marry her and procured her consent only for the reason of having sexual relation with her.”
