Assam: Hearing on PIL against NCHAC polls extension in 2nd week of August

The Public Interest Litigation (PIL) which was filed by Ex-MLA Samarjit Haflongbar and admitted by the Division Bench comprising Chief Justice Ajit Singh and Justice Achintya Malla Bujor Baruah of Gauhati High Court on June 13, 2018, has been listed again for hearing on the 2nd week of August.

The PIL was filed by Haflongbar against the Assam Government, Secretary to the Governor of Assam, State Election Commission, North Cachar Hills Autonomous Council (NCHAC) and Deputy Commissioner, Dima Hasao for extending North Cachar Hills Autonomous Council (NCHAC), 2018 election for six months on the ground that 80 per cent of officers and staff members are engaged in National Register of Citizens (NRC) updating work for which it would not be possible to hold the election even after expiry of the term of the NCHAC.

The same ground was challenged at the High Court stating that only 5 per cent of officers and staff members are engaged in the NRC updating work.

Senior advocate BD Das assisted by advocate Desrindao Thaosen are appearing for the petitioner ex-MLA Samarjit Haflongbar, while Additional Advocate General D Saikia assisted by R Dhar are appearing for the Assam Government, Secretary to the Governor of Assam and Deputy Commissioner of Dima Hasao and the standing counsel of State Election Commission is appearing for the State Election Commission and the standing counsel of NCHAC K Goswami is appearing for the NCHAC.
