A local court in Western Assam’s Dhubri has rejected the bail plea of all alleged land brokers who were arrested during a statewide drive against the land brokers initiated following the Chief Minister directives on September 21.
Rejecting the bail petitions of all 24 persons, the court said, “In view of the submissions of the learned APP, petitioners counsel and after going into detail reading of the case-diary in hand, I am of the opinion that the sections under which the case is registered are not the final sections under which the investigating authority is bound to submit the Charge-sheet.”

“The sections of the law are initially registered on a prima facie reading of FIR so that a proper line of investigation can be initiated and thereafter, necessary materials against the alleged involved persons could be gathered,” he added.
“Further, after threadbare reading of the case-diary, it is seen that the investigation of the instant case has just been initiated and all necessary efforts are being made by the Investigation Officer (I.O.) to gather important documents and links so that involvement of other persons in the case could be ruled in. Also the present status of investigation reveals that the documents which have been seized from the residences and workplaces of the alleged accused persons are under proper scrutiny before the appropriate authority and many documents are yet to be recovered,” the court said.
“Moreover, considering the fact that this case involves alleged huge misappropriation of public land documents for the purpose of wrongful gain, any leniency at this stage of the case would affect all the fruitful efforts of investigation which is going on in a very detailed manner. Also, some of the material witnesses are yet to be examined and involvement of some other persons is also ruled in as it appears from the case-diary” the court added.

The court rejected the bail pleas of Mohidul Azom Sarkar, Saif Uddin, Jakir Hussain, Abdul Kuddus Mollah, Uttam Kumar Saha, Owas Ali, Hafizur Rahman, Chan Miah, Aynul Hoque, Tapan Kumar Ray, Nur Jamal Hoque, Sultan Ali, Abdul Baten, Sha Alam Ahmed, Faruk Ahmed, Gulach Khan, Jamsher Dalal alias Jamsher Ali, Sajid Khan alias Abdul Sajid Khan, Nalini Ranjan Nath, Manik Khan Abdul Hussain, Subir Kr. Saha, Abdul Jobbar Ali and Abdul Basir Akond.
The Assam police have so far arrested over 500 people for allegedly being involved in the illegal trade of land purchasing and sale.
