Guwahati: Chief Justice of India Surya Kant on Monday ordered a fact-finding enquiry into an apparent lapse by the Supreme Court Registry in implementing a judicial direction.

A Bench comprising CJI Kant and Justice Joymalya Bagchi observed that an earlier court order had specifically directed issuance of notice to the Enforcement Directorate (ED). However, the Registryโ€™s office report stated that no such direction had been issued.

Questioning the omission, the Bench sought an explanation for the failure to send notice to the ED. During the hearing, the CJI criticised the functioning of the Registry, describing it as โ€œvery nastyโ€ and remarking that officials behaved as though they were โ€œsuper Chief Justice of Indiaโ€.

The court directed the Registrar (Judicial) to explain why the direction was omitted from the records and why notice was not issued to the ED.

The CJI also noted that concerns regarding the functioning of the Registry had surfaced earlier as well, indicating the need for a โ€œdeeper probeโ€ into the issue.

The remarks were made during the hearing of a bail plea filed by Ayushi Mittal alias Ayushi Agarwal, who is accused in an alleged investment fraud case involving more than Rs 37,000 crore.
