The Assam government has ordered that a person having more than 2 living children on or after January 1, 2021 from single or multiple partners will not be eligible for state government jobs.
The state government has issued a notice for the execution of its policy on small family norms in the selection process of candidates for direct recruitment to the state government services and posts under the Assam government.
The notice (No ABP. 69/2019/PL/20) says: “No person having more than two living children on or after 01/01/2021 from a single or multiple partners shall be eligible for appointment in any services and posts under the state government.”
The notice said if an applicant has only one living child from the earlier delivery but more than one child is born out of a single subsequent delivery, the children so born shall be deemed to be one entity while counting the number of children.
“Further, a person having more than two living children before 01/01/2021 shall not be ineligible so long as the number of children he/she has before 01/01/2021 does not increase on or after 01/01/201,” the notification says.
According to the notice, no person shall be eligible for appointment to any service and post under the Assam government if the person has married in violation of The Prohibition of Child Marriage Act, 2006.
The notice, issued by the additional secretary to the Assam government, Personnel (B) department, says no government servant shall have more than two living children from a single or multiple partners on or after January 1, 2021.
“One or more children born on or after the said date from a single subsequent delivery shall be deemed to be one entity while counting the number of children,” the notice said.
Further, the government servants having more than two living children before January 1, 2021 shall not be deemed to commit misconduct so long as the number of children he/she does not increase on or after January 1, 2021.
The notice also said every government servant shall on his first appointment to any service or post and thereafter at such intervals as may be specified by the Assam government, submit a declaration giving the details of members of his family in the form appended to these rules.
